The rise of the use of generative AI as a research tool across industries is evident and this development extends also to research in the pharma and biotech fields. This panel will focus on issues related to use of generative AI and its impact on patenting. The panel will explore, e.g., formal issues such as whether AI generated results can represent an invention as intended in patent law, but in particular focus on the substantive issues such as: whether AI generated results can be the sole results in support of an invention, whether additional (traditional, real world) data could be or should be presented as further support, and whether there should be an obligation to mark results as being AI generated or real-world generated.
